In my country, Australia, this footage would almost certainly be used against the person in criminal way.

Present laws here in the state of Victoria dictate that you must fly no less than 30 metres from people in any situation, NO flying in ANY national park (although you can stand outside a park and fly in, providing the craft takes off and lands outside park boundaries). On top of this we have local council bylaws that build on our federally regulated safety agency CASA. CASA has used youtube footage to successfully prosecute people who post their 'drone experiences', including fines and a criminal record.

On top of this we have this 'Nanny state' mentality whereby disgruntled neighbours OR people walking their dog may take a disliking to your activities and call police.

I'm curious.... What is the law with drone usage in the U.S?
